Texas adopted the Uniform Trade Secrets Act (“UTSA” or “TUTSA”) on September 1, 2013, which governs trade secrets misappropriation cases brought under Texas state law. Subsequently, in May 2016, the United States Congress passed the Defend Trade Secrets Act (“DTSA”) which governs trade secrets misappropriation claims brought under Federal law. The two laws differ slightly and based on the facts of the case, attorneys will work with clients to determine under which law to bring a lawsuit.
