Wendy’s practice focuses on civil and business litigation in both state and federal court. Wendy has considerable experience representing both Plaintiffs and Defendants in trademark infringement, unfair competition, trade dress misappropriation and copyright infringement lawsuits. Wendy’s practice also includes contract disputes, licensing, fiduciary claims, general business and tort litigation.
Wendy’s representative experience includes, without limitation, the following:
- Obtaining Jury Verdict in trademark infringement lawsuit in favor of defendant (Wendy’s client) finding that the Trademark is Generic resulting in Court Order to cancel the plaintiff’s Generic Trademark;
- Defending website owner against allegations of copyright infringement;
- Defending performing artist against claims of copyright infringement;
- Defending software developer in copyright infringement, unfair competition and breach of contract lawsuit;
- Representing local internet business in a trademark cancellation proceeding before the USPTO TTAB;
- Defending Texas Motorcycle Club against claims of Trademark Infringement and Unfair Competition;
- Defending national retailer against claims of trademark infringement;
- Representing national publisher in lawsuit involving claims of business opportunity, breach of contract and trademark infringement;
- Representing local retailer in lawsuit involving trademark infringement, unfair competition and related claims;
- Representing British musician in lawsuit involving trademark and copyright infringement related to famous 1980’s Pop music band; and
- Defending local retailer against trademark infringement lawsuit in the Central District of California.
