Wendy B. Mills is an experienced litigator and transactional attorney

Wendy has represented international, national and local small and mid-sized businesses in the following industries without limitation: technology, music recording, retail, manufacturing, publishing, software, education, advertising; restaurant; and real estate.

Litigation Experience

Wendy's practice focuses on civil and commercial litigation in both state and federal court. She has considerable experience in trademark and copyright litigation representing both Plaintiffs and Defendants in trademark infringement, unfair competition, and copyright infringement lawsuits. Her litigation practice also includes contract disputes, trade secret misappropriation, fiduciary claims, general business and tort litigation.

Trademark/Copyright Prosecution and Trademark Trial and Appeal Board Experience

Wendy also represents clients concerning trademark prosecution (trademark registration) trademark cancellation and opposition proceedings before the United States Patent and Trademark Office (USPTO) and Trademark Trial and Appeal Board (TTAB).

General Counsel Experience

Wendy provides licensing and contracting assistance for small businesses that occasionally need a general counsel. She brings to her litigation practice the unique perspective gained as General Counsel for a multi-national company headquartered in Dallas, Texas.

Representative Experience

  • Obtaining Jury Verdict in trademark infringement lawsuit in favor of defendant (Wendy's client) finding that the Trademark is Generic resulting in Court Order to cancel the Generic Trademark
  • Defending website owner against allegations of copyright infringement
  • Defending software developer in copyright infringement, unfair competition and breach of contract lawsuit
  • Defending famous dog trainer in defense of trademark infringement, fiduciary duty claims and contract claims involving the trademark "RIN TIN TIN"
  • Representing local internet business in a trademark cancellation proceeding before the USPTO TTAB
  • Defending Texas Motorcycle Club against claims of Trademark Infringement and Unfair Competition
  • Defending national retailer against claims of trademark infringement
  • Representing national publisher in lawsuit involving claims of business opportunity, breach of contract and trademark infringement
  • Representing local retailer in lawsuit involving trademark infringement, unfair competition and related claims
  • Representing British musician in lawsuit involving trademark and copyright infringement related to famous 1980's Pop music band
